Mumzheaven Terms and Conditions
apply to the use of this website and any promotional
emails or leaflets in relation to this website. By
accessing this website and/or placing an order on
this website you agree to these Terms and Conditions.
By placing an order with Mumzheaven you are deemed
to have read, understood and agreed to these Terms
and Conditions.

Placing
an Order: To buy products
from this website, browse our online shop, select
the items you wish to buy by clicking on the 'buy
now' button on each product page. This will place
an item in your shopping cart. Once you have placed
an item in the shopping cart you may wish to continue
browsing. To do this click on the 'continue shopping'
button to return back to the store. When you've finished
shopping select the "Checkout" button to
make your payment and complete your order.
During checkout you
will be asked for a few details that we need to be
able to satisfy your order and you will be given the
option to pay by credit or debit card through our
payment processor Barclays ePDQ or Paypal. If you
choose to pay by Paypal you won't need an account
to pay, although you will be offered the opportunity
to use the information you have provided to open an
account if you so wish. Please make sure you complete
the checkout process correctly - if you have made
a payment this will be confirmed to you at the end
of the checkout process.
We will send to you an email acknowledging and detailing
the products you have ordered.
This is not a confirmation of your order nor is it
an order acceptance from us.
Order acceptance and the completion of the contract
between you and us will take place once ordered products
are despatched, unless we notify you otherwise.
Non-acceptance of an order may be due to the following:
The
product in your order is not available from stock
or a supplier.
We
are unable to authorise your payment.
We
have identified an error in the product description
or price.
Whilst we take every effort
to ensure that the colour of products in our photographs
are as accurate as possible there may be slight variations
due to the limitations of photographic and calibrations
of different imaging devices.
Payments:
Mumzheaven accepts payment for goods in the following
ways:
Credit
or debit card via Paypal or any other SSL (Secure
Socket Layer) payment processor
made available to you on this website
Postal
Order
Cheque
(made payable to Mumzheaven)
Banker's
Draft
If you are paying by cheque,
Mumzheaven will wait 10 days for your cheque to clear
before processing your order. In such instances, delivery
times may exceed the usual maximum of 28 days. The
address to send it to appears at the end of these
Terms.
VAT:
All prices quoted on our website include VAT.
Back
Orders: If the goods you want are out of
stock, we will happily back order for you. However,
this may involve a waiting period beyond the control
of Mumzheaven. In these cases, we will inform you
and if you wish to cancel your order, you can do so
without charge.
Order
Cancellations: You can cancel an order
placed with Mumzheaven provided you contact us immediately
quoting your order number. In the event it has already
been prepared for despatch to you, you will incur
a charge for delivery. If the item is already in the
hands of our courier or the postal service and is
on it's way to you, we are unable to cancel your order
and you must then follow our returns policy in order
to receive a refund.
Stock
Availability: In order to provide such a wide
range of stock to our customers it is not possible
for us to keep stock of every product we sell. Some
products especially large items will be ordered from
the distributor/manufacturer and we therefore cannot
guarantee stock availability.

during office hours which are 9.30am to 5.30pm Mon-Fri.
Delivery:
Standard delivery charge per order = £6.95
Specialist Carrier Delivery per order = £29.95
(larger items of furniture - identified on product
page)
Delivery is to the UK mainland
only. We do not deliver to offshore locations within
the UK or the Highlands and Islands of Scotland.
We aim to despatch items
within 7 days of receiving your order, but please
allow 7-14 working days for your items to arrive.
In some instances the item may take up to 28 days
- we will always notify you if there is to be any
significant delay to your order.
Items are sent via Royal
Mail or by courier. We aim to deliver items by courier
within 3 working days. We are unable to confirm at
what time a delivery by courier will arrive.
Delivery times may vary
depending on location and whether the item is despatched
direct from ourselves or a manufacturer or distributor.
If there is any significant delay to you receiving
an item you will be notified and given the opportunity
to wait for the item or consider a suitable replacement
or an immediate refund.
As the majority of larger
items are sent via courier please ensure that we have
your telephone number and an up-to-date delivery address
to pass to the courier in case there is any query
regarding delivery. We also need to be notified of
any special delivery instructions ie, if your address
is new or difficult to access/locate etc. Delivery
will be made to the ground floor of your premises.
Where access to the delivery
address is limited or additional equipment is needed
to complete the delivery, an additional charge to
cover the full costs of these services will apply.
All deliveries by courier
will require a signature. Please ensure that somebody
is available to sign for the item otherwise it will
be returned to a local depot. The courier will leave
a card with a phone number for you to call to arrange
a further delivery or collection.
Failure to arrange redelivery
or collection of the item will result in the item
being returned to us. On receipt of the returned item,
a refund will be issued to the customer less the original
delivery cost and the courier fee for returning the
item to us.
We shall use reasonable
endeavours to meet any date agreed for delivery. In
any event time of delivery shall not be of the essence
and we shall not be liable for any losses, costs,
damages or expenses incurred by the buyer or any third
party arising directly or indirectly out of any failure
to meet any estimated delivery date.
If the products ordered
by the buyer are not available or discontinued and
the seller is unable to deliver them to the buyer
within 45 days (or any other time limit agreed by
the parties), the seller shall inform the buyer of
this; cancel the contract; and reimburse any sums
paid no later than 30 days after the due date for
delivery.
Any liability to the seller
for the non-delivery of products shall be limited
to replacing the products within a reasonable time
or issuing a respective credit note.
Delivery
charges: Delivery costs are simply
£6.95 for your complete order, regardless of
how many items you buy or their weight. You can review
your order, including the £6.95 delivery charge
at any time by clicking on the view cart button. You
can add and remove items from your shopping cart as
necessary before you complete your order at the checkout.
Specialist Carrier Delivery:
Certain items of furniture are delivered by a
specialist carrier who will carefully handle and deliver
your goods to you in one piece and at your convenience.
You will not be given a generic 9am-5pm delivery time,
forcing you to wait in all day. Our delivery team
will contact you a few days after you have placed
your order, to discuss possible delivery dates and
times with you. On the day of delivery the driver
will call you when approximately 1 hour away from
your home, removing the need for you to wait inside
all day. Please be sure to provide us with a landline
and a mobile number when placing your order so the
driver can easily contact you.
All items subject to specialist
carrier delivery will be clearly identified on their
product page of our website.
Specialist carrier delivery
is charged at £29.95 per delivery not item,
therefore regardless of the amount of furniture items
delivered, provided they are ordered at the same time
delivery will be only £29.95. This will appear
in the shopping cart as £23.00 'Specialist Carrier
Hand Delivery' + the standard £6.95 delivery
charge = £29.95.
We aim to despatch specialist
carrier delivery items within 7-14 days of you placing
your order. If your items are not in stock we will
discuss delivery timescales with you to ensure they
are acceptable.
A signature will be required
on delivery to take ownership of the goods and deliveries
will be made to the ground floor of your premises.
At the time of ordering you are able to request an
alternative delivery address if this is more convenient
to you.
Important Note:
Please inspect your goods and only sign the delivery
note once you are happy they have arrived in good
order.
If you need to change your
agreed delivery date please contact us immediately.
If our delivery team attempt to deliver to you on
the pre-arranged date but are unsuccessful, you will
incur a £50 charge for a second delivery. Our
specialist delivery carriers impose this charge.
Damaged
Goods: Our carriers will take the utmost
care in delivering your product in perfect condition.
In the event of an item sustaining damage in transit
this should be clearly visible by the packaging. Please
inspect the goods before signing and write on the
delivery note that the item was received damaged.
Please then email us within two days of receiving
the item at return@mumzheaven.co.uk advising us. We
will then contact you and depending on the circumstances
we may arrange collection of the goods and delivery
of a replacement to you. Only if the item is in unused
condition and in the original packaging will an exchange
be made. In certain instances a replacement part may
be sent without the need to exchange the original
item.
Faulty
Goods: If an item appears faulty, provided
that the item is unused and in the original packaging
and we are contacted within two days of you receiving
the item, we will collect the item and send a replacement
item to you. In certain instances a replacement part
may be sent without the need to exchange the original
item.
Returns:
We take pride in the knowledge that we have carefully
selected our products and their manufacturers. If
in the event the product is not exactly what you expected
then you may return it to us, provided that:
(a)
The goods are returned to us within 7 days of delivery
to you.
(b)
You have contacted us first by email at return@mumzheaven.co.uk
to
obtain a goods return reference number. This reference
must be
written on a note and sent to us with your returned
item stating
your reason for return - please do not write on the
packaging.
(c) The goods
are unused, in fully re-saleable condition and in
their
original undamaged packaging.
(d) They are sent
to us by a traceable, insured method that
requires a signature on delivery.
(e) The goods
are returned at the customer's expense.
We reserve the right
to charge a collection fee, should the customer make
the goods available for collection.
Exceptions: Health and Safety regulations
mean we cannot accept the return of mattresses when
they have been unwrapped and removed from their original
packaging.
We regret that we cannot accept the return of any
furniture that has been part of fully assembled.
We cannot accept the return
of items that have been personalised by the customer's
request.
On
receipt of return: Once we have taken
receipt of the returned goods we will inspect them
as to their suitability for re-sale. Provided the
goods are supplied to us as above we shall provide
a refund within 28 days to the customer for the returned
goods (excluding original delivery costs).
If you return your item
outside the initial 7-day period, we may still accept
the return providing the item is in fully re-saleable
condition and in its original packaging. In this instance,
we will provide a credit note for the original sale
value, less original delivery costs.
Please note, where goods
are returned for reasons other than fault or damage
and do not reach us in perfect saleable condition
we reserve the right to charge a percentage of the
refund value of the returned goods.
If an item is returned for
reasons other than damage or fault and you wish to
replace this item with an alternative, you must place
a new order. We will not send out alternative goods.
Damaged Goods:
If your goods are damaged or faulty, and you
have identified this before accepting delivery, then
please contact us immediately. We will arrange for
collection of your items and organise a full replacement,
exchange or refund. Naturally, in this instance we
will cover all subsequent shipping costs.
Please Note:
We cannot refund any items of furniture that have
been part of fully assembled.
If the fault is found to
be a non-manufacturing fault, you will be charged
for any subsequent repair. We will supply you with
an estimate before any work commences.
We will not commence with
any repair work until you notify us. However, if you
do not reply to us within 14 days, we will return
the goods to you un-repaired.
Of course, if the faults
are identified as a manufacturing defect, the repairs
will be made free-of-charge.
We do not provide a loan
service while goods are being repaired.
Refunds:
As soon as goods are received and verified
by us, we will authorise and arrange a refund, replacement,
repair or exchange.
Your refund will be sent
back to you using your original payment method. For
example, if you paid by PayPal, your refund will be
made via PayPal.
We guarantee that refunds
will be processed and administered back to you within
28 days of your goods being returned, in the absence
of any dispute.
Links
to Third Parties: To provide an enjoyable
shopping experience while using our site we may provide
links to other websites for you to access from our
website at your sole discretion. You agree and acknowledge
that as you have chosen to enter such linked websites
on your own volition that we do not endorse or are
not in any way responsible or liable directly or indirectly
for any:
content,
products, advertising, services or resources provided
to you
fact
or actuality relating to content
loss,
damage or offence relating to any matter arising out
of perusing such websites.
Complaints:
We are committed to the highest levels of customer
service and do all that we reasonable can to make
shopping with us a pleasure. However, if you are unhappy
with any aspect of our service and wish to make a
complaint, please email full details to us at complaints@mumzheaven.co.uk.
We will confirm receipt
of your complaint within 48 hours and hope to resolve
the matter within 7 days.
Safety
Instructions: Please make sure you thoroughly
read and understand all the manufacturer's safety
instructions. Mumzheaven cannot be held responsible
for unsafe use of any item purchased through our website.
Warranty: All
goods sold on this website are warranted free from
defects in material and workmanship. If we should
receive a written complaint by email from a customer
regarding goods found to be defective in respect of
materials or workmanship within 30 days of delivery,
Mumzheaven will after we have had a reasonable time
to investigate the same and examine the goods in dispute
shall be entitled at our discretion to repair or replace
the defective goods or refund the purchase price or
issue a credit note. Original delivery costs are non-refundable.
No claim will be made in
respect of any goods which have been repaired or altered
in any way or have been subject to any accident or
damage caused by either wilful or innocent neglect
or through use not in accordance with the manufacturer's
instructions by the customer.
Please refer to manufacturer's
product documentation for information relating to
warranties, including duration.
All items of furniture
sent via specialist carrier delivery carry
a 2 year guarantee to protect you against manufacturing
defects.
Customers accept that they
agree to these Terms and Conditions prior to making
a purchase from Mumzheaven.
Our
rights: We reserve the right to at any
time to:
(a)
withdraw or modify either temporarily or permanently
(all or part of) this
website with or without notice to you and that we
shall not be
responsible or liable to you or any third party for
doing so, and
(b)
alter the conditions of this website whenever
deemed necessary and by
use of this website you agree to accept such change.
Responsibility to
determine whether changes have been made to this site
is of the user.
If you do not agree to any change to these conditions
then you
must immediately cease using this website.
Privacy:
We respect your privacy and we do not disclose
buyers' information to third parties. Information
supplied to us will only be used in accordance with
the following:

We will take all reasonable steps to make sure the
details of your order and payment are secure, however
in the absence of negligence on our part we cannot
be held responsible or liable for any loss you may
